I have a 1st gen iphone and am upgrading to 3G. Can I still use my old iphone as a ipod touch?

I believe that you can. I believe that once the iPhone has been activated once, the software becomes open, as opposed to when you first get the iPhone and it wants you to activate it.

I can't guarantee you that I am right though as I don't have iPhone.

Yes, you can - AT&T will "let" you use it as a WiFi-enabled iPod. Mighty kind of them, considering the cost, don't you think? :-)

It makes sense that you CAN. Back before you ever activated you would have been able to use the phone for it's iPOD functionality. That should carry over to other basic functions.

Definitely ask AT&T.

Yes, you can.

In order to avoid the phone getting re-locked though, you will want to jailbreak it. Although that may sounds scary if you've never done it, it just involves running a program on your desktop with your iPhone connected via USB, and takes less than 5 minutes.

When new iPhone firmware is released, do not download it right away. Instead, wait until that new version has also been jailbroken, and then upgrade. The reason for this suggestion is that with some firmware upgrades, the phone gets relocked and will ask for activation. If you wait until the firmware has been jailbroken, then you avoid that hassle.

I've done this with my first generation iPhone, and everything works just fine. The only issue is that you need to remember that, despite it being an iPhone, it has no cell signal, so nothing that connects to the Internet will work unless you have a Wi-Fi connection.

Yes you are able to use it as an iPod Touch and have all the functionality available. The iPhone doesn't require a SIM card for any application except the Phone/SMS applications to work.
Using Wifi you'll be able to download applications on it from the App Store, browse the web and of course listen to music.

Further more you could use it as a phone where you have Wifi access using a free VOIP application. Search for Truphone on the app store.

I am not as convinced. If you take your SIM out and turn the phone on what happens? Can you use it then?

What happens when you get the 3G iphone and service to the old SIM is disconnected? I imagine it will say something along the lines of invalid SIM until one is inserted.

If I am right, and I hope I am wrong, you can always jailbreak the phone.

Yes, though at one time the 1st gen iPhone was selling very well on eBay and could possibly earn you enough money to buy either your new iPhone 3G or a brand new iPod Touch.
