how do you pursue a lawsuit against a tobacco company?

My mom was a faithful smoker for fifty years. She got hooked back in the fifties, and did not manage to quit until 2008. Now I am watching her slowly suffocate to death. She says it feels like there's sponge in her chest and no air can get through. The doctors are doing everything they can to try to improve her breathing, but the sad truth is, it will continue to get progressively worse. At seventy seven, she would not survive a lung transplant, and she also lost a brother to the same condition. He was also a lifelong smoker. Smoking was glamorized back when she was a young woman. It was seen as harmless fun. When I see the look of fear in her eyes when she can't get her breath, it makes me want to scream. The cigarettes also caused severe PAD, and she lost her right leg below the knee in 2009. She is fighting to keep the other leg. Smoking has severely and negatively affected her quality of life to the point that she is no longer capable of being mobile for long because of the shortness of breath. Is there any chance she would have a case?

I know it sounds harsh to say this, but as the law stands you are going to have little in the way of a case. My main reasoning for this would be that in 1964 there were major developments in the understanding of tobacco on health. You would be more than likely to find that the case would cost you more than you could care to dream of, and if the case were to fail you would be liable to pay for any proceedings taken in a court of the Law.

The opposition would in my opinion would be that there are lots of ways that the health service can help you give up smoking, and that's it's a matter of wanting to stop that will drive people to stop. And if it is only now that your mother is severely impaired has stopped her then it shows little willing to give up.
