How do we bring our company into legal legitimacy?
Right now we are a consulting partnership using a DBA with no FEIN. Our income goes through our personal accounts. Other than applying for the FEIN, what steps do we need to take to move our start-up into legal legitimacy?

1. Do register an original trademark line at www.uspto.gov
2. File your business name but first you will have to look up your intended fictitious business name and see if it is being used by others. The county is the governing entity in many states for this. If the name is available you can file a DBA or “Doing Business As” with the governing agency to reserve it for yourself.
3. You can also publish the notification of your intent to do business as a DBA in a newspaper that is in general circulation and certified by the local registrar. You have to do this to insure that the public is notified of your intent and to allow rivals to stake a competing claim.
4. Once your name is published and the newspaper will provide proof of publication, you can then open a bank account in your business’s name. You can also get checks printed with your business name and logo and start accepting payments made out of your business.
