Cesar Chavez Day is celebrated in many states. However, according to timeanddate.com it is officially observed by Colorado, Texas, and California this year:
"Tue Mar 31 2009 César Chávez Day State holiday CO*, CA, TX*"
Texas and Colorado are marked with "*" as it is an optional observation.
As stated, it is celebrated in many different area such as: New Mexico, California, Arizona, Nevada, Utah, Colorado, and Texas. Also this year there was an official statement by President Obama that mentions Cesar Chavez day.

I see conflicting accounts of the number of states that celebrate Cesar Chavez Day. Is it 8,9 or 10 and which states are they?

Short Answer: 1 officially, 2 officially optional, 50 as anyone can celebrate it in a manner they wish. Cesar Chavez Day is celebrated in many states. However, according to timeanddate.com it is officially observed by Colorado, Texas, and California this year:
