The FCC isn't actually reopening the case. It is simply going through all the legal channels (STILL!!)
The US Court of Appeals sided with CBS. They said that the TV network should not be held responsible for airing an unscripted, (to CBS's knowledge) inappropriate (to some viewers) scene. It's the same situation as when ABC aired the Academy Awards and Bono said "This is f---ing brilliant." ABC should not be held responsible for him saying that, because it wasn't scripted or planned, and ABC is only airing the coverage.
In the Super Bowl, CBS was only airing it. The halftime show was being put on by MTV, and was planned out by that network. However, the Supreme Court disagreed with the Court of Appeals, and sent the case back down for review. We will see how it turns out.
