Even if his wife was being harassed by the animal, beating it is just a stupid thing to do - it will only make the animal more aggressive. After all, if someone started beating you with a stick, wouldn't you fight back?
Him and his wife should both have had the common sense to just run away from the bird and the ice cream. There's no excuse for beating the animal, it's only making the situation worse. And repeatedly hitting it, to the point where the bird's wing broke? That's not a simple one or two-hit defensive measure, that's going to town!

I would have protected my food but if the gulls got it then they got it. I would not have attacked them.
It's not even one of the larger gulls.
They are endangered because they mostly breed on one island, not because of occasional conflicts. It's really a matter of habitat protection.

Was the ice cream really worth it?
This guy in California wanted his ice cream so bad he beat a rare gull with a stick. The bird suffered a broken wing and had to be put to sleep. Would you have just given the bird(s) your ice cream?

- Fact Refuted
Having ice cream doesn't make you a food addict, he was acting in self defense in this case.

The birds were trying to get the food not attack the people. They are probably used to being fed by people on the beach. The couple from Kansas were probably completely unfamiliar with seagulls. There was certainly no need to beat the birds with a stick. I would have protected my food but if the gulls got it then they got it. I would not have attacked them.

It must have been scary as heck getting attacked by a flock of birds. Swooping and screeching. I would have run my butt off and hoped they didn't chase me!
