How absurd is the class action lawsuit on Dannon Activia?
So there is a 35 million dollar class action suit against Dannon saying the probiotic Yogurt Activia does not offer the health advantages it says it does.
The woman who started the suit says she was having digestive problems so she started eating Activia to "cure" her problem. However long later she is still sick and she is not fixed. So she is suing them.
Then of course with the greediness of our public everyone has joined in.
All you get is $100 from the suit.
But really?
Dont you think if you have medical problems you would do what? maybe go see a doctor instead of going to your dairy aisle?
Its like that law suit against McDonalds in the 90's for the women spiling her coffee.
2 months later 1 million dollar pay out.
Is it just me or is this just people looking for a pay out or do they really have a case and if not is there any other crazy lawsuits out there?

People looking for a payout.
I use Activia for digestion problem instead of metamucail, fibercon, or etc.
It certainly helps with loose movements and constipation.
I even read it helps pain medicated people who have a hard time digesting actually pass.
I don't get how they can request a lawsuit when they say right there on the package that if it doesn't work you can get your money back up to $12.
It says works in 14 days. one a day is two 8 packs of it. with 2 left over.
a 8 pack is less then $6 so there is your money back.
What did this women eat 20 8packs of the stuff?
Ludicrous.

I think its different to the McDonalds case... at least in some respect. McDonalds never claimed its coffee was iced... or chilled, or made any mention of the temperature at all...
Dannon however do make claims about the benefits to your health of their yogurt. They also promote it as aiding digestion, and say that you should feel better if its drunk on a daily basis.
Now, whilst you, me, and any vaguely intelligent person would also go to their doctor if they had this sort of problem I think that the marketing people at Dannon does share some of the culpability here. At the very least they are promoting the 'health benefits' of their product they should also make it clear what research backs it up, what the limitations are etc...
I'd be very disappointed if this womans 'lack of common sense' earned her millions of dollars... but if it lead to more truthful advertising I'd be happy.

I tend to think that since they are treating the yogurt as a medicine, to fix your digestion, that the claims need to be evaluated by the FDA and treated like a medicine. Proper labeling, contraindications, etc. You can't make a medical claim on a non-medical product and get away with it. But yes, pretty stupid that this person did not go see their doctor. Self treatment just isn't the best thing to do in most cases.

I dont think they are treating it like medicine tho.
They say it can help but it surely isn't in your pharmacy.
Anything in my dairy aisle i consider a typical food product.
Arizona Ice tea says their antioxidants help keep you healthy but no ones suing them.
