Cell Phones Bans:

Handheld Cell Phone Bans for All Drivers: 5 states (California, Connecticut, New Jersey, New York and Washington), the District of Columbia and the Virgin Islands prohibit all drivers from talking on handheld cell phones while driving.

* With the exception of Washington State, these laws are all primary enforcement—an officer may ticket a driver for using a handheld cell phone while driving without any other traffic offense taking place.

Text Messaging:

Text Messaging: 14 states and the District of Columbia now ban text messaging for all drivers.

* Novice Drivers: 10 states prohibit text messaging by novice drivers.
* School Bus Drivers: 2 states legally restrict school bus drivers from texting while driving.

No, in NJ it is illegal to either talk on your cell without a hands free or text while driving. If a cop catches you, you'll probably get a ticket for reckless or careless driving.

I'm a Jersey girl too and the answer is yes it is illegal. I've noticed that the police are really cracking down on it too, some of my friends received warnings or tickets.

Aside from it being illegal it is also immoral because it's just an accident waiting to happen. Nothing is so important that it can't wait until you pull over or get to your destination. But facing charges for manslaughter or vehicular homicide is something to think about. The person texting would have to live with that guilt the rest of their life - that is if they even survived the accident!
