Only Colorado, Illinois, Iowa and New Hampshire have no helmet laws.
In Alaska, Arizona, Hawaii, Indiana, New Mexico, Utah and Maine helmets are optional if you are over 18.
On the other hand, I don't see where the government has the right to require someone to wear either. If you don't want to wear a seatbelt, or helmet then who else are you affecting? You should be able to choose to, or choose not to participate in any safety procedure.

Actually, it depends on the state. I'm trying to find a list of states which require wearing a helmet, but I can't seem to find one.

As the two other answers have already pointed out, depends on the state and if it is legal. Only 4 states completely allow you to ride without. http://i141.photobucket.com/albums/r60/hereisaaron/helmet.jpg

I've also heard that when you are driving without a seat belt you put the other passengers at risk... remember that forward that went around a couple of years ago. The one where the Grandpa made sure his Grand daughter had her seat belt on, but then he didn't put one on himself. Long story short- they get in a wreck and his body crushes hers. He walks away, she dies. Not wearing a seat belt puts more people at risk than just yourself. Not wearing a helmet only puts yourself at risk...
