For politicians or celebrities, then you have to weigh First Amendment rights against commercial interests. How would the image be used? Is it to make a statement or being used for commercial gain? If you are planning on using the President's image on a t-shirt, bobblehead, etc. and sell it, it would be recommended that you contact an attorney prior to doing so, to see the legalities behind this, so that you don't get into any trouble. It's likely that it's ok now since he's the President.
