Can the President license his image?

With all of the Obama coins, plates, shirts, and back scratchers being sold now, can the President license his image to control what is actually legally sold with his likeness/image?

If it is possible, can a sitting President benefit financially from the licensing
while in office?

I am not a lawyer, yet I'm sure he can license his brand logo and his image.  Also, it's important to note that images and photographs are also typically protected by copyright.  However, for him to register and go after everyone who uses his image everywhere would be work and probably cost more than it's worth to some extent, so it's not worth the headache of doing this.  I'm pretty sure he has more important things to be concerned with than this, but he can certainly do this.

For politicians or celebrities, then you have to weigh First Amendment rights against commercial interests. How would the image be used? Is it to make a statement or being used for commercial gain?  If you are planning on using the President's image on a t-shirt, bobblehead, etc. and sell it, it would be recommended that you contact an attorney prior to doing so, to see the legalities behind this, so that you don't get into any trouble. It's likely that it's ok now since he's the President.

What obnoxious money grubbers that family is. Having a famous ancestor shouldn't make them wealthy, and it interferes with free political speech as well.

Because Obama is an elected official, his words and image are in the public domain and can be used without permission.
