It is legal, but Apple is so anal about having control over their products they're actually intent on changing the law.
Thanks to lobbyists and bribery lots of crap laws get pushed in corrupt nations, including the USA... ever wonder why you don't have free healthcare while so much of the GDP goes towards medicare?
The only thing Apple can do is brick your phone... they have the right to kill their own products, you agreed to that by using it.

But if you are thing about it, I would not worry about being sued, but Apple can still try and brick your phone if they want to.

Is Jailbreaking iPhone legal ?
If you Jailbreak or even unlock your iPhone or iPod Touch, is it considered illegal officially ? For that matter, if you flash your iPod with say, an open source medial player software, is that illegal too ?

The answer is still up in the air. The courts will likely decided later this year. But if you are thing about it, I would not worry about being sued, but Apple can still try and brick your phone if they want to.

It is not illegal and that is simply because you OWN the hardware. End of story. Apple can try to make it illegal all they want, but once you own a device it is up to you what you do with it. Now then, jailbreaking may render the warranty obsolete and may ruin your phone...so proceed with caution.
