Darrell Kruse Trial
Darrell Kruse owned and operated a
medical marijuana dispensary in
Claremont,
California, until the city ordered it closed in February, 2007, on the grounds that Kruse did not have city permission to operate the facility. While the state of
California allows for legal medicinal marijuana and dispensaries, Claremont refused Kruse a
license. In March, 2008, attorneys for Kruse argued in court that the city lacked the authority to close his shop. The city council will reconsider a one-dispensary ordinance in May of 2008. If Kruse wins the decision his facility may be reopened, although other applicants have expressed interest in holding the permit that Kruse seeks.
